Workers' Compensation Class Codes Related to Bars, Taverns and Breweries

Employees are grouped into classification codes based on what they do for their job. The National Council on Compensation Insurance (NCCI) currently utilizes nearly 800 class codes to help insurance companies categorize employees. Insurance companies create a manual rate for each class code in order to price a policy.

Properly classifying workers is an important part of the quote process. Mis-classified employers may end up paying too much for coverage or owing too much after an audit.

Class Code 9084 | Bar and Brewery- All Employees

Businesses primarily engaged in hospitality services related to food and alcohol or alcohol only. A restaurant will generally fall under this class code when more than 50% of gross sales are derived from the sell alcoholic beverages such as beer, wine or liquor. Businesses often include bars, nightclubs, lounges, and taverns. Sports bars, restaurants and caterers may also fall under this code depending on alcohol revenue. Musicians and entertainers can often be included under this class when performing in the venue. Many other modern ventures that derive revenue from the sell of alcohol may also be contemplated under this class. Wineries generally fall under a separate class code: 2143- Winery and Drivers.

Alternative State Class Codes for Bar and Brewery:

Sometimes a state will deviate from the industry class code recommended by NCCI. Instead of the NCCI code, they may require the utilization of a state specific class code for certain business segments.

Class Code State
9079 | Taverns and Restaurants California / Texas
899 | Bar or Tavern Delaware / Pennsylvania
108 | Brewery Delaware / Pennsylvania
9074 | Bar, Tavern, Nightclub New York

Synonyms: bar, sports bar, restaurant with alcohol, nightclub, tavern, lounge, brew pub, brewery.

What Does Workers' Comp Cover?

What does workers comp cover?

Workers' comp coverage protects employees when injured. It makes good financial sense for both parties.

Injuries and accidents happen. A workers' comp policy is a no-fault system that pays for these accidents and claims. It's required by law in most states.
  • Loss of income for employees unable to perform job duties
  • Medical expenses for employees injured on the job
  • Retraining expenses for employees unable to return
  • Permanent injury or disability for lasting injuries
  • Survivor benefits if employees are killed on the job

Coverage does not protect employers from everything. Sometimes employees and employers can be negligent.

Workmans comp does not cover negligence
In some instances, workers' compensation coverage will not protect employers or employees from the legal liability resulting from a workplace injury.
  • Injuries resulting from a violation of the law
  • Incidents resulting from employees' use fo drugs or alcohol
  • Injuries that did not occur in connection with the job
  • Clear company policy violations
  • Injuries that did not occur in connection with the job
